1. General
For all legal transactions with the clients our “Terms and Conditions of Business” are exclusively valid. They can only be amended by a written individual agreement. Other general terms and conditions of business cannot be used. Prices are valid up until a new price list is released. The version valid at the time of the conclusion of the contract shall be valid. This can also be viewed on the internet at www.pinoshop.de. In the case of special offers the offered price on the special promotion is valid for a limited period. Customers in the sense of these Terms and Conditions of Business are traders in the sense of the national Civil Code of the Costumers fiscal domicil.
All prices exclude VAT. Taxes & Duties are the responsibility of the recipient in the country of destination. Free standard delivery. Minimum order value € 250.
2. Offers and acceptance
- The customer's order, the offer, is binding for the customer.
- The offer shall be accepted by us within a reasonable time period after receipt of offer by written confirmation of the offer or by delivery of the goods. For equipment the reasonable time period should not exceed 4 weeks. With preparations we endeavor to deliver the goods within 5 days after receipt of the bank transfer.
- We expressly reserve the right not to deliver or to not to deliver in due time, if unforeseeable circumstances arise that despite reasonable efforts cannot be overcome and are not our fault or if circumstances exist that may endanger the intended sale of the goods or the payment.
- Our description of the goods on the internet does not represent an offer, but rather is a non-binding invitation to the customer to order.
3. Delivery
The delivery takes place ex-stock. Dispatch to the customer takes place following their request, irrespective of who bears the costs of the transport in the individual cases (consignment purchase).
- Free standard delivery. Minimum order value € 250.
- Costs not covered by type of delivery, such as assembly or running-in costs, are to be borne by the customer.
4. Warrantee
- PINO must be notified of all complaints and returns in advance. You will receive a complaint number in the case of a return which must be attached to the goods.
- For goods sent with unasked carriage forward or goods without a complaint number we reserve the right to refuse collection. If the goods are nevertheless taken back a service charge of 5% of the order value will be charged, however, at least € 10.
- Complaints of obvious faults in the goods can only be taken into consideration if they are received in writing within 2 weeks of receipt of goods. For faults which are not obvious a warrantee of 12 months is valid.
- In the case of legitimate claims we will deliver goods without defects as a replacement for the rejected goods or repair the already delivered goods. If, however, in spite of all due care a fault cannot be remedied the customer has the right to chose either to withdraw from the sale or to receive a reduction of the sale price.
- However a reduction due to negligible defects shall be excluded.
- A warrantee for defects which are due to the nature of the goods cannot be given.
- For additional liabilities arising from intent and gross negligence the limitations in liability laid out in section 5 are valid.
5. Limitation of liability
- In the case of minor negligent breach of duty our liability is restricted to the foreseeable typical average damages for the type of goods. This is also valid for minor negligent breach of duty by our agents or veracious agents. In the case of minor negligent breaches of duty of non-essential contractual obligations we do not accept liability.
- The aforesaid liability limitations do not affect the rights resulting from product liability. Furthermore, the liability limitations are not valid with regard to physical and health damages which can be attributed to us and to loss of life.
- Claims for damages due to defects are subject to a limitation period of one year following delivery of the goods. This does not apply when we can be accused of fraudulent intent.
6. Payment and arrears
- Our conditions of payment are: nett cash in advanced. The ordered goods will not leave our warehouse before we have received the bank transfer on our account.
7. Contractual exclusion of set-off
The customer can only off-set claims that have been explicitly recognized by us or are deemed legally binding.
8. Data security
The client permits PINO, within the legal framework, to save and process personal data or to use it for their own purposes. PINO will not use the customers’ data or pass it on to a third party over and above that necessary for processing customers’ orders and customer service. Customers are informed by the data protection information on the homepage of PINO at the address www.pinoshop.de on all aspects of security of personal data and explicitly accept these regulations.
10. Court of jurisdiction
With customers who are general merchants, legal persons under
public law or a special fund under public law, the court of jurisdiction is agreed to be Hamburg.

Constructive changes as well as deviations in structure, design and color are excepted as well as mistakes and printing errors.
